Xarelto Lawsuit Cases Make Progress Amid Growing Public Concern

TheProductLawyers.com announces the latest developments in the cases against Xarelto and its manufacturers, Janssen Pharmaceuticals (a division of Johnson & Johnson) and Bayer AG. As 2015 came to a close, the U.S. Judicial Panel on Multidistrict Litigation chose to combine the 2,800 suits claiming harm from use of the anticoagulant in order to expedite the judicial process. By creating the multidistrict litigation (MDL) case number 2592, hearings will proceed more swiftly towards resolution. Judge Eldon Fallon will preside over the cases in the MDL in the Eastern District of Louisiana.

2017 will see four bellwether cases presented for jury panels. This process will provide an opportunity to observe juror reactions to evidence and testimony, which will assist in the future presentation of other case materials. The first and second bellwether cases will commence on February 6th and March 13th of 2017, in the Eastern District of Louisiana. However, the third and fourth cases are slated to be tried in other locations on April 24th and May 30th, respectively.

While Xarelto was initially heralded as a medical breakthrough, both physicians, and the public have since taken a somewhat dimmer view of the new-generation anticoagulant. The drug and its manufacturers have been the objects of scrutiny in a mounting number of lawsuits, which now approach 4,000 individual claims. Many of the plaintiffs represented in MDL 2592 claim that use of the drug placed patients at an increased risk of a catastrophic bleeding event, and further allege that the drug's manufacturers were negligent in their duty to inform both doctors and patients of this risk.

Even as the bellwether trials approach their dates, plaintiffs are confident that additional cases will continue to swell their numbers. A similar combination of cases is scheduled to appear before the Court of Common Pleas in Philadelphia, Pennsylvania. The mass tort program represents 550 individual claimants who also claim negligence on the part of the drug manufacturers and exposure to the risk of serious bleeding events.
