Xarelto Lawsuit Cases Have Been Scheduled for Spring 2017 by Judge Eldon Fallon Who Oversees Multidistrict Litigation (MDL)

TheProductLawyers.com reports on Xarelto, a new-generation blood-thinning drug manufactured by Bayer Healthcare AG and Janssen Pharmaceuticals (a division of the Johnson and Johnson Corporation). Xarelto has been the focus of a multitude of lawsuits that have alleged that those that have taken the drug are at an increased risk and have actually experienced instances of spontaneous and uncontrollable bleeding. In many of the lawsuits awaiting trial dates, Xarelto has been associated with gastrointestinal bleeding, blood clots, brain hemorrhages and strokes. Another claim being made in many of the lawsuits that have been and continue to be filed is that the manufacturers of Xarelto did not properly notify the public or medical professionals about the very serious risks connected to the drug.

Currently, there are 2,800 lawsuits that comprise the multidistrict litigation (MDL) being overseen by the Honorable Judge Eldon Fallon. The MDL has been assigned number 2592. Judge Fallon had ordered that a pool of 40 cases be identified by January 11, 2016 from which 4 cases would be chosen as bellwether trials to be heard in 2017. The court has released information related to the first two bellwether trials that will be held in the Eastern District of Louisiana. The dates of these initial trials have been set for February 6th and March 13th of 2017. Subsequent bellwether trials have been scheduled for April 24th and May 30th of 2017.

The intent of these 4 fast approaching Xarelto MDL trials is to be a harbinger of what may ensue once juries begin to deliberate and render their decisions on plaintiff allegations surrounding their use of Xarelto. Plaintiffs and their attorneys are anxiously awaiting the outcome of these initial trials in terms of how juries will react to the arguments and evidence presented by prosecuting lawyers.
